Privacy Policy and Rules of www.metaltema.lt:

1. General provisions

1.1. The rules of www.metaltema.lt electronic shop (hereinafter referred to as www.metaltema.lt) (hereinafter referred to as
Rules) shall apply to the Customer when placing an order at

read and accepted the Terms and Conditions if, prior to ordering the Goods, the Customer confirms his/her
acceptance of the Terms and Conditions by clicking on “I AGREE”. In cases where the Customer does not accept
all or part of the Terms and Conditions, he/she must not place an order electronically
with the www.metaltema.lt Shop, otherwise the Customer shall be deemed to have read and
unconditionally accepted all the Terms and Conditions of the Shop.
1.4. www.metaltema.lt shall be exempt from any liability in the event that losses are incurred by
as a result of the Customer’s failure to read the
Shop Rules, notwithstanding the advice given to it and its obligations, even though it was given the opportunity to do so.

2. Privacy Policy

2.1. When ordering goods, the Customer must provide the following personal data of the Customer
necessary for the delivery of the goods: name; surname; address to which the goods will be delivered; telephone number; any other data necessary for
the delivery of the goods. www.metaltema.lt confirms that such data will be used exclusively by
for the purpose of ordering and delivering the goods. www.metaltema.lt undertakes not to disclose
such information to any third party, except for www.metaltema.lt’s partners providing
the delivery of the goods or any other services related to the placing or execution of the Customer’s order. Any exceptions to
‘s disclosure of Customer’s personal information to third parties shall be coordinated with Customer in all
cases. In all other cases, any disclosure of the Customer’s
personal information to third parties may only be made in the cases provided for by the legislation of the Republic of Lithuania.
2.2.The Customer confirms that he/she is of legal age (minors may only dispose of their
personal funds with the consent of their parents or legal guardians) and has the right to order goods from
the www.metaltema.lt Store. In the event that the Customer discloses his/her
login details, www.metaltema.lt shall be exempt from any liability in this respect.
2.3. By reading the Terms and Conditions, the Customer confirms that he/she is informed that when browsing the
www.metaltema.lt Shop, cookie files (files sent from the
web server) will be placed on his/her computer.

3. Ordering procedure and conditions

3.1. The Customer visits the Shop’s website and chooses the
products he/she likes. On the basis of his/her choice, a shopping cart is formed.

: his/her name, surname, the address to which the goods will be delivered, telephone number and additional
information that may be important for the delivery of the ordered goods. www.metaltema.lt confirms that the data provided by the Customer
will be used exclusively for the purposes of the sale and delivery of the goods
, in compliance with the requirements of the legislation of the Republic of Lithuania on personal data protection.The Customer
must then select one of the possible payment methods in the www.metaltema.lt Shop (see more in section IV of the
Rules).
3.3. The last window generates all the data provided by the Customer, before
confirming which the Customer must make sure that the data provided is correct and in accordance with his
preferences. The Customer shall have the opportunity to correct any erroneous data before sending the order
www.metaltema.lt The Customer shall also be given the opportunity to correct the personal data
necessary for the delivery of the goods after the order has been placed. The Customer shall not be given the opportunity
to confirm the order until he/she has indicated that he/she has read and accepted
www.metaltema.lt the Terms and Conditions of the Shop. In the event that the Customer
has not read the Shop Rules before selecting the goods, he/she must do so before confirming his/her
order and the data contained therein.
3.4. Once the Customer has confirmed the order, it shall be sent to www.metaltema.lt The order shall be deemed to have been placed by
from the moment it is received by www.metaltema.lt. At the same time, a contract shall be deemed to have been concluded between
the Customer and www.metaltema.lt. However, such contract shall be deemed to be enforceable only by

3.5. After the Customer has placed an order, the www.metaltema.lt system shall automatically send the Customer an email from
indicating the goods ordered and the Customer’s details.
3.6. When www.metaltema.lt receives a notice from the bank that the Customer has made a payment order to
to purchase the goods from the Shop, the Customer shall be sent a notification to the email address indicated in the

Address. The moment of receipt of the notification from the bank shall be considered as the moment of commencement of the performance of the contract between the Customer and

3.7. The order placed by the Customer shall be stored in the database of www.metaltema.lt in accordance with the requirements of the applicable legislation of
the Republic of Lithuania regarding the term of storage of such data

3..8 In all cases, the Customer shall be deemed to have read and unconditionally
accepted all the Terms and Conditions of the Shop, as well as all other terms and conditions specified in the order

3.9 The Contract shall be concluded and executed in Lithuanian.

4. Warranty and pricing of goods

4.1.The characteristics of each item shall be indicated generally for each item in the Shop.
4.2.The Customer agrees that when placing an order electronically in the Shop, he/she undertakes to pay
for the goods at the price stated in the order.
4.3.The prices in the Shop and on the Order Form shall be quoted in Euro including all applicable taxes.
4.4.www.metaltema.lt sells the goods in accordance with the terms and conditions of the order.
In cases
where the goods delivered to the Customer do not comply with certain requirements of the order, the Customer agrees to
first immediately notify www.metaltema.lt by telephone, and the latter undertakes to take all
steps to remedy the existing defects, if such defects are due to the fault of www.metaltema.lt or
any third parties acting on its behalf. www.metaltema.lt in the event of failure to remedy the defects within a reasonable period of time agreed
with the Customer, the Customer shall have the right to assert its rights in the manner provided for in the Civil Code of the Republic of Lithuania
..5 Obligations of www.metaltema.lt in relation to the goods:
4.5.1 www.metaltema.lt undertakes to deliver the goods of proper quality and in accordance with the requirements set out in the order
.
4.5.2 www.metaltema.lt undertakes to deliver to the Customer the quantity of goods specified in the order.
www.metaltema.lt shall not be liable in cases where the quantity of goods delivered is not accurate due to
the Customer’s incorrect specification of the data in the order placed with www.metaltema.lt
4.5.3 In cases where the order specifies a particular set of items, www.metaltema.lt
undertakes to deliver all the items included in the set. 4.5.4 The Goods shall be delivered to
packed in a manner appropriate to their nature to ensure that they are fit for their intended use.

5. Payment procedure and terms

5.1. The Customer shall pay for the goods ordered by one of the methods indicated in the www.metaltema.lt Shop
: OPAY service, bank transfer or any other secure and appropriate method indicated in the
payment window.
5.2. If the Customer has chosen one of the online payment methods, he/she undertakes to pay for the ordered
goods immediately, otherwise he/she loses the right to claim for violation of the
delivery deadlines, as the shipment of goods according to the Customer’s order starts
forming only after www.metaltema.lt receipt of payment for the goods.

6. Returning goods

6.1.The Customer shall be given the opportunity to exchange the items handed over to him/her for items of the same but different dimensions.
6.2.Goods shall be returned only upon arrival at the main office – UAB Metaltema Marijampolės g. 84A,
Antanavo k., LT-69367
6.3.Replacement and return of goods is possible only when the goods being exchanged or returned comply with the following
requirements:

  • (a) have not been used;
  • (b) have not been damaged;
  • (c) the preservation of the consumer characteristics of the goods;
  • (d) has not lost its marketable appearance.

Alterations to the packaging necessary for the inspection of the goods shall not be considered as material damage or loss of merchantable appearance
. In all cases, the goods must be returned in their original packaging, including
any label not removed from the goods www.metaltema.lt. When returning the goods, the Customer must in all cases
provide www.metaltema.lt the documents of purchase of the goods.
6.4.Replacement or return of the goods shall be carried out by the Customer by contacting the staff of www.metaltema.lt
by e-mail metaltema1@gmail.com and then by arriving at the place – UAB Metaltema
Marijampolės g. 84A, Antanavo k., LT-69367. The Customer, when submitting the request, shall provide a document proving the fact of purchase
, as well as indicating which items are being returned or exchanged, and for what
reason.
6.5. In cases where the goods are exchanged and a difference in price arises as a result of such an exchange, the Customer
shall be obliged to pay www.metaltema.lt such price difference. The price difference shall be paid to
by bank transfer to the bank account specified by www.metaltema.lt.
6.6. In cases where www.metaltema.lt does not have items suitable for replacement, the Customer shall be refunded the amount paid by
, excluding the cost of delivery.
6.7. The Goods may only be exchanged or refunded if they comply with the requirements set out in paragraph 3 of this part of the Terms and Conditions
. The refund will be made no later than 14 days after the
refund form has been signed. Amounts paid for delivery shall not be refunded to the Customer.
6.8 During promotions and sales, special conditions apply to the return of goods, which
are mandatory.

7. Delivery of goods

7.1. www.metaltema.lt undertakes to dispatch the Goods to the Customer no later than within 1 – 4 working days
from the date of confirmation of the execution of the order to the Customer. This time limit does not apply in those
cases where www.metaltema.lt stock is not available and the Customer is informed of a shortage of the goods ordered on
(when ordering, the Customer sees
“Pre-order” next to the selected product. At the same time, the Customer agrees that in exceptional cases the delivery of the goods may
be delayed due to unforeseen circumstances. In such a case, www.metaltema.lt undertakes to contact the Customer immediately
and to agree on the delivery of the goods.
7.2 The Customer undertakes to specify the delivery address and the person who will
receive the goods when ordering the goods.
7.3 The Customer undertakes to accept the goods himself. In the event that the Customer is unable to accept the goods himself, and
the goods have been delivered to the address indicated and on the basis of other data provided by the Customer, the Customer
shall not have the right to claim www.metaltema.lt for delivery of the goods to the wrong entity.
7.4. Goods ordered from www.metaltema.lt online store shall be delivered only in the methods offered on the website
.
7.5. In the event of non-collection of the goods due to the Customer’s fault or due to circumstances beyond the Customer’s control, the goods shall be returned to
www.metaltema.lt and the Customer shall not be entitled to make any claim for non-delivery of the goods to
on time. In addition, www.metaltema.lt shall in all cases be exempt from liability for any breach of the
delivery time limits if the goods are not delivered to the Customer or are not delivered on time
due to the Customer’s fault or circumstances beyond the Customer’s control.
7.6 The Customer shall immediately notify www.metaltema.lt by email in all cases
where the shipment is delivered in damaged, broken or otherwise defective packaging; also in those
cases where the shipment contains goods not ordered or the wrong quantity of such goods,
an incomplete set of goods, or goods of the wrong size, dimensions.
7.7 In all cases where the packaging of the Consignment is creased, wet or
otherwise externally damaged upon collection by the Customer, the Customer shall indicate (make a note) on the collection slip or
draw up a separate report in respect of such defects. The Customer must do this in the presence of the person
handing over the goods. Failure to do so shall relieve www.metaltema.lt from
liability to the Customer for damage to the goods, provided that such damage was caused by packaging
defects not noted by the Customer in the delivery confirmation.
7.8. In cases when upon receipt of the goods the Customer notices that the parcel does not contain the right set of goods
or the goods provided are not of the right size, colour, the Customer must immediately
inform www.metaltema.lt about it.
7.9. Parcels sent via post offices are stored in parcel terminals for 7 (seven) days.
In case of the failure of the Customer to collect the parcel from the receipt of the SMS about the delivery of the parcel within seven days, the parcel
shall be returned to the Seller. If the Customer re-sends the parcel, he/she is obliged to www.metaltema.lt
pay the additional shipping costs of € 5 (five) (return of the parcel for € 2.5 and re-sending of the
parcel for € 2.5).
7.10. The Customer’s incorrectly entered telephone number for not receiving an SMS message of the delivery of the parcel
to the post office does not relieve the Customer of his/her obligation to pay the amount recorded in p. 9 in the event of a request for the re-sending of the www.metaltema.lt parcel by the
seller.
